Lit Event Hire as Service Provider
TERMS AND CONDITIONS OF HIRE
1. AGREEMENT
a. These Terms govern the terms on which Lit Event Hire agrees to the hire of Equipment to the Client and Client agrees to be
exclusively bound by these Terms and Conditions of Hire (the “Hire Agreement”).
b. Hire is strictly for private use. Lit Event Hire agrees to enter in the Hire Agreement with the private individual defined in
Section 1 of the attached Client Booking Form (“Client”), in order to provide items for hire as detailed within Section 3 the
“Equipment”, in exchange for the “Hire Fees” defined in Section 4.
c. Client’s attention is particularly drawn to Annex I – “Safety Guidance” relating to the safe use of the Equipment. By acceptance of
these Terms and Conditions of Hire, Client hereby acknowledges and shall adhere to the Safety Guidance.
2. TERM
a. The term of the Hire Agreement commences once the Equipment has been installed by Lit Event Hire and ends twenty-four
(24) hours later or as otherwise mutually agreed in writing (the “Term”). The initial Term may be extended upon mutual
agreement of both Parties.
3. GENERAL
a. Client is solely responsible for, and agrees to, the safe keeping of Equipment whilst under its care and control.
b. Client shall ensure Equipment is (i) stored securely, (ii) kept in good working condition and (iii) always used safely for the
intended purpose whilst in their possession for the duration of the Term.
c. In the event of damage to Equipment during the Term as a result of either (i) negligence, (ii) misuse or (iii) accident, Client shall bare
the cost of repairs.
d. In the event that Equipment is damaged beyond economical repair or is lost or stolen whilst under the care and control of the Client,
Client shall bare the full replacement costs of Equipment. Such replacement costs shall be limited to the full fair market replacement
value as determined at the time. In the event of dispute, Lit Event Hire shall substantiate its costs by commercial invoice or quotation
from its suppliers.
e. The Customer shall not assign, transfer or sub-contract any Hire Agreement to any third party without Lit Event Hire’s prior written
consent.
f. Smoking is not allowed inside the Igloo or within a 3 metre Radius of the Igloo. Naked flames such, as but not limited to, candles,
sparklers, fireworks, matches, lighters are also not permitted for use within a 3-metre radius of the Igloo.
g. Unless specifically requested otherwise, Client authorises Lit Event Hire to use photographs from the event, strictly for the purposes
of publicity within its marketing channels.
4. PAYMENT TERMS
a. The Hire Fees payable in advance. Payment is strictly prior to delivery and subject to payment confirmation. A nonrefundable fee of £50 is payable in advance to secure the booking the “Deposit”.
5. DELIVERY
a. Lit Event Hire will use its commercially reasonable endeavours to ensure that pre-agreed delivery and collection times are adhered to.
However, Lit Event Hire cannot accept responsibility for late deliveries or collections, due to any unforeseen circumstances.
6. COVID-19
a. To comply with UK Government Regulations, Lit Event Hire shall use commercially reasonable endeavours to clean and sanitize
Equipment prior to hire. Client shall grant outside access to Lit Event Hire in order to safely install Equipment. Lit Event Hire
politely asks Client to ensure face masks are worn in order to comply with UK Government Regulations.
7. LIABILITY AND INDEMNITY
a. Lit Event Hire makes no warranty or representation of any kind with respect to any Equipment as to merchantability, fitness for
purpose, condition, quality, material design suitability, workmanship or operation of any kind or nature. All other conditions
warranties or representations expressed or implied (save for the conditions implied by section 12 of the Sale of Goods Act 1979),
statutory or otherwise are, to the fullest extent permitted by law, expressly excluded.
b. Lit Event Hire accepts no responsibility for any injuries or claims whilst using the Equipment and its total liability in contract (including
for any statutory interest payable), tort (including negligence or breach of statutory duty), misrepresentation, restitution or
otherwise, arising in connection with the performance or contemplated performance of these Terms and Conditions of Hire
(including for any statutory interest payable) shall be limited to the Hire Fee.
c. Client indemnifies and holds Lit event Hire harmless against all taxes, levies, duties, charges, assessments, or withholdings of any
nature for which Lit event Hire may be liable by operation of these Terms and Conditions of Hire and for any legal costs incurred by Lit
Event Hire in enforcing any of its rights in respect of these Terms and Conditions of Hire.
8. FORCE MAJEURE
a. Neither Lit Even Hire nor Client shall be in breach of these Terms and Conditions of Hire nor liable for delay in performing, or failure
to perform, any of its obligations under these Terms and Conditions of Hire if such delay or failure results from events, circumstances
or causes beyond its reasonable control, and in such circumstances the affected party shall be entitled to a reasonable extension of
the time for performing such obligations, provided that if the period of delay or non-performance continues for six months the party
not affected may terminate these Terms and Conditions of Hire by giving 14 days’ written notice to the other party.
9. DISPUTE RESOLUTION, LAW AND JURISDICTION
a. These Terms and Conditions of Hire, and any dispute arising from them (including non-contractual disputes or claims) shall be
interpreted in accordance with the laws of England and Wales.

Annex I – Safety Guidance
The following Terms (the “Safety Guidance”) provide guidance to the Client which relate to the safe use of the Equipment. It is a mandatory requirement that
the Client must familiarize themself with these Terms prior to acceptance of the Hire Agreement.
1. Materials used within the construction of the Equipment (such as but not limited to the PVC cover of the Igloo) are combustible when exposed to
a naked flame or excessive heat.
2. Therefore, naked flames (such as but not limited to cigarettes, candles, lighters, matches, sparklers, fireworks) are not permitted in or around the
Equipment.
3. Heat emitting items (such as but not limited to heaters, lighting, electrical appliances) are strictly not permitted to be directed at the Equipment
coverings. For avoidance of doubt heaters may be used within the Equipment but should not be directed at the Equipment cover or covered
whilst in use.
4. Naked flames and smoking are strictly prohibited within the Equipment and within the immediate vicinity of the Equipment.
5. Due to its waterproof nature, some materials used within the construction of the Equipment (such as but not limited to the PVC cover of the
Igloo) are non-breathable.
6. The Client is responsible for ensuring a constant supply of fresh clean air is free to circulate the Equipment. Two window vents are available for
use which can be demonstrated upon request by Lit Event Hire.
7. Use of toxic or hypoxic gases, chemicals and smoke of any nature is strictly prohibited within the Equipment.
8. The Equipment is not designed to slept in.
9. Children should not be left unsupervised in or around the Equipment.
10. All electrical items must be switched off at the source power supply whilst Equipment is not occupied or supervised.
11. The Igloo is wind resistant up to 50-62km/h (6Bft) When properly fixed with the anchorage kit provided.
12. Maximum snow load capacity is: 40kg. For the avoidance of any doubt snow load in excess of 40kg could cause structural failure of the
Equipment, therefore, use of the Equipment beyond this level is not permitted.
13. The Equipment is not safe for use on, or in, water.
14. The Equipment should not be used during extreme weather conditions such as but not limited to high winds, electrical storms, severe rain or
flooding.
15. Should the Client have any questions relating to the safe use of the Equipment, they must raise such questions with Lit Event Hire via email at
Hello@liteventhire.co.uk prior to signature.
16. Failure to adhere to the instructions within the Safety Guidance may result with serious injury or death. Lit Event Hire accepts no liability for any
such occurrence due to Client negligence or accident.
17. By signing the Hire Agreement Client acknowledges their understanding of, and adherence to, the Safety Guidance in accordance with the Hire
